1. Acceptance of Terms

Welcome to CapsHold. By accessing and using our platform, you agree to comply with and be bound by the following Terms of Use. If you do not agree with any part of these terms, you should not use our services.

These terms constitute a legal agreement between you and CapsHold Corp. ("we", "our", "company"). By creating an account or using our services, you confirm that you have read, understood, and accept all terms described herein.

2. Definitions

• Platform: Refers to the website, web application, and all services offered by CapsHold.
• Capsule: Refers to the encrypted digital vault created by the user to store content.
• Content: Refers to any text, image, video, audio, document, or file uploaded by the user.
• User: Refers to any person who accesses or uses the platform.
• Opening Date: Refers to the future date scheduled by the user for releasing the capsule content.
• Rescue Code: Refers to the unique code necessary to access the capsule content.

3. Use of Service

3.1. Eligibility

You must be at least 18 years old to use our services. By creating an account, you declare and warrant that you have the legal capacity to enter into this agreement and that all information provided is true and accurate.

3.2. User Account

You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3. Capsule Creation

When creating a capsule, you agree to:

• Provide accurate information about the recipient and opening date
• Ensure you have all necessary rights to the content uploaded
• Not upload illegal, offensive, defamatory content or content that violates third-party rights
• Respect the storage limits of the chosen plan

4. Prohibited Content

You may not use our platform to store, transmit, or share:

• Illegal content, including but not limited to material that violates local, state, or federal laws
• Pornographic, obscene, or sexually explicit material
• Content that promotes violence, hatred, discrimination, or harassment
• False or misleading information
• Malware, viruses, or malicious code
• Content that violates third-party intellectual property rights
• Personal information of third parties without consent
• Content that may cause harm to minors

We reserve the right to remove any content that violates these terms, without prior notice, and to terminate accounts that repeatedly violate these policies.

5. Intellectual Property

5.1. Your Content

You retain all ownership rights to the content you upload through our platform. By using our services, you grant us a limited, non-exclusive, and revocable license to store, process, and transmit your content solely to provide the requested services.

5.2. Platform Ownership

All intellectual property rights related to the platform, including but not limited to design, code, logos, trademarks, and documentation, are the exclusive property of CapsHold Corp. You may not copy, modify, distribute, or create derivative works based on our platform without prior written authorization.

6. Privacy and Security

We take the privacy and security of your data very seriously. We use end-to-end encryption and enterprise-grade security technologies to protect your content. For more information on how we collect, use, and protect your data, please see our Privacy Policy.

You are responsible for maintaining the security of your rescue code. We do not share rescue codes with third parties and cannot recover capsules if you lose your access code.

7. Payments and Refunds

7.1. Pricing

Our service prices are displayed in Brazilian Reais (BRL) and may be changed at any time. Price changes will not affect already created and paid capsules.

7.2. Payment

Payment is processed through secure third-party payment providers. You agree to provide accurate payment information and authorize us to charge the amounts due.

7.3. Early Opening

We offer the option of early opening upon payment of an additional fee equivalent to 40% of the capsule value. This fee is non-refundable after the early opening is processed.

7.4. Refunds

Refunds may be requested within 7 days of purchase, provided the capsule has not been opened or the opening date has not passed. Refunds are processed according to our refund policy and may take up to 10 business days to be credited.

8. Limitation of Liability

CapsHold Corp. shall not be liable for:

• Loss or corruption of data due to technical failures beyond our reasonable control
• Loss of rescue codes or unauthorized access due to user negligence
• Indirect, incidental, or consequential damages arising from the use or inability to use the services
• Third-party content or actions of other users
• Temporary service interruptions due to maintenance or updates

Our total liability shall not exceed the amount paid by you for services in the last 12 months.

9. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without prior notice. We shall not be liable for any loss resulting from such modifications.

9.1. Service Availability and Discontinuation

You acknowledge and agree that the service may be discontinued or go offline at any time, including but not limited to the following situations:

• When performance, growth, or financial viability expectations are not met
• In case of significant financial losses that make service operation unviable
• For technical, operational, or security reasons
• By strategic company decision
• For legal or regulatory reasons

Although we make our best efforts to keep the service available, we do not guarantee continuous or uninterrupted availability. You acknowledge that use of the service is at your own risk, and that CapsHold Corp. shall not be liable for any loss of data, content, or access resulting from service discontinuation or unavailability.

We may update these Terms of Use periodically. Significant changes will be communicated through platform notifications or by email. Continued use of services after such changes constitutes acceptance of the new terms.

10. Termination

You may terminate your account at any time through account settings. We may suspend or terminate your account immediately, without prior notice, if you violate these Terms of Use.

After account termination, your capsules will be maintained until their respective opening dates, provided they have not been violated or removed for terms violation. Already opened capsules will remain accessible for a period of 30 days after opening.

11. Applicable Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any dispute arising from these terms shall be resolved in the competent courts of Brazil, to the exclusion of any other forum.
